Waiver and Release from Liability

We are Solo In Style Ltd, a company registered in England under company number 14431080 whose registered office address is Studio 20 14 Feathers Place, London, England, SE10 9NE.  Our affiliate is Team Lipstick, LLC whose registered company address is 533 8th Street, Brooklyn, New York 11215. 

For purposes of this Agreement, “Solo In Style” shall mean Team Lipstick, LLC, and each of their respective affiliates, directors, officers, representatives, agents, employees, consultants, hired coaches, hired professionals and third parties, volunteers and sponsors. The event you are purchasing is therefore governed by the laws of New York State, USA. “Solo In Style Events” shall mean any form of participation in the Solo In Style travel event, including without limitation all activities planned during the travel event, working with third-party entities for tours, physical activities, and other organized activities. 

Preliminary Statements

You accept responsibility to ensure that you do not behave in a way which causes disruption or offence to others or risks any loss or damage to property belonging to others or our suppliers. Payments for any such damage or loss must be made at the time direct to the accommodation owner or manager or another supplier. You indemnify us against any claims (including legal costs) subsequently made against us as a result of your actions.

If in our reasonable opinion or in the opinion of any other persons in authority you are behaving in such a way to cause or are likely to cause distress, danger or harm to any third party or damage to property, we reserve the right to terminate your arrangements without notice. In this situation, your total booking with us will immediately cease and we will not be responsible for paying any costs, expenses, refunds or compensation.

In consideration for your being accepted as a client of Solo In Style, you, and on behalf of your spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, and anyone else that may sue on your behalf, hereby agree to the following provisions and make the following representations pursuant to this Agreement, Waiver and Release from Liability (this “Agreement”).

Documentation

Your specific passport and visa requirements and other immigration requirements are your sole responsibility and you should confirm these with the relevant Embassies and/or Consulates of the destinations you intend to visit abroad.  Check general visa, passport, health and safety information prior to booking.

You must hold a valid ID with a photograph i.e. International Passport. It is your responsibility to ensure that you have a valid photo ID. Most countries require a passport to have a certain period of validity left on it, such as 6 months, or a number of blank pages. It is your responsibility to make enquiries into the validity requirements of your passport in relation to the countries you are travelling between. It is your responsibility to make sure you arrange your visa and that you have the correct documentation to allow entry, and travel to and from, the country you are visiting. You should check with your own government as we are unable to advise you and nor shall we be liable or responsible for any issues you experience in relation to proof of identity or validity of your passport or other travel documents. We do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. Please note that these requirements may change between booking and departure and it is therefore your sole responsibility to ensure that you have the most up-to-date information prior to travelling.

Health and Fitness

You acknowledge and agree that it is your responsibility to determine whether you are sufficiently fit and healthy enough to safely participate in any Solo In Style Event. You hereby represent and warrant that you are or will be sufficiently healthy and fit and physically trained to participate in any Solo In Style Event which you elect to enter.  You represent and warrant that you have no physical or medical condition that could endanger yourself or others if you participate in any Solo In Style event.  You represent and warrant that your statements in the Application Questionnaire are accurate to the best of your knowledge, and that your physical condition has been verified as sufficient to participate in Solo In Style Events by a licensed medical doctor. 

Health requirements and vaccinations are updated by various destinations regularly and may change at any time. We suggest you consult your doctor before you depart at least 8 weeks prior to departure. It is your responsibility to ensure you have obtained all the necessary vaccinations required for your trip and in accordance with your doctor’s recommendations prior to travel. We do not accept any responsibility if you are unable to travel as a result of your failure to comply with any necessary health requirements.

All of our holidays require a good level of fitness to take part in the self-guided and organised tours, excursions or any optional activities. We will also, on occasion, provide some stretch classes and other light exercise classes during your holiday. It is your responsibility to ensure that your fitness is at a good level prior to booking your holiday with us. We shall not be responsible and nor will we provide you with a refund if you are advised by a medical practitioner not to take part in any of the tours or organised exercise classes or the holiday in its entirety. It is your responsibility to speak to your medical practitioner prior to booking your holiday with us to check you are fit to travel.

If you have any food allergies or specific dietary requirements, it is important that you advise us at the time of booking. It is also essential that you make the private chef (where relevant) aware of your allergies or dietary requirements after arriving and ask for information about ingredients before eating. You are also reminded that any required medications should be kept with you at all times.

Insurance

It is a condition of your booking that you’re adequately insured for your trip. We therefore strongly advise that you arrange adequate insurance cover as soon as possible either prior to or as soon after booking your holiday with us. You must be adequately insured for all your needs to cover all contingencies such as cancellations, medical expenses, repatriation, and baggage cover. We reserve the right to request a copy of your insurance. While on holiday, should you choose to take part in any activity which can be deemed as being of a hazardous nature (for example, hang gliding, hot air ballooning, white-water rafting, etc.), it is essential to ensure that cover is provided under the terms of your travel insurance. If you are in doubt, you should contact your insurer. The organisers of some adventure activities that you may choose to take part in whilst on holiday may request that you sign a waiver of their liability for the risks involved. We must draw your attention to the fact that by signing such a document you may well lose any rights to claim for damages in respect of death, injury, or loss of or damage to property even if negligence on the part of the activity organiser is proven to have occurred. We do not accept any liability in relation to any loss you suffer during your holiday in these circumstances or any of the other terms of this waiver.

Damage and Loss

We take care to ensure that all involved in the preparation and supply of your holiday maintain the highest standards. Please remember that the appropriate standards will be those prevalent in your destination which may not be the same as developed international standards.

Please note, we cannot accept any liability for any damage, loss, expense or other sum(s) of any description:

·       which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you.

·       if you or any member of your group is at fault; if the failure is the fault of someone else not connected with providing the services which form part of the holiday we provide; the failure is due to any unusual or unexpected circumstances beyond our control, which we could not have avoided even if we had used all care possible or the failure is due to any event which we or the supplier of any service could not help, expect or prevent.

·       for any services that do not form part of our contract. This includes, for example, any additional services or facilities that the hotel or any other supplier agrees to provide for you where the services or facilities are not advertised on our website as forming part of your holiday and we have not agreed to arrange them as part of our contract, and any excursion / activities you purchase while away.

Travellers have the same responsibility for their personal safety and that of their possessions, as they do at home. We organise holidays in many parts of the world, some of which do not conform to the same health and safety standards as you would expect in your own country. Whilst we always check that any accommodation we provide complies with the local regulations applicable in that country for health and safety, we cannot guarantee that these meet the standards in your own country and therefore urge that you undertake reasonable precautions to protect yourself whilst on holiday. We shall not be liable for your safety when you are travelling with us.

Photos and Videos

You give Solo In Style, and any photographer or videographer they may choose, the irrevocable right, AFTER YOU HAVE GIVEN PERMISSION, to use your picture, portrait, video or photograph in all forms, media and manners, without restriction as to changes or alterations, for advertising, trade, promotion, exhibition or any other lawful purpose. You reserve the right to inspect and approve the photographs or electronic matter that may be used.  Once permission is granted, you waiver any right to royalties or other compensation arising from or related to the use of the photographs.

Assumption of Risk

You understand that Risks may be caused in whole or in part by your own actions, inactions or negligence, the actions, inactions or negligence of others, including those participating in Solo in Style Events, or the actions, inaction or negligence of the persons comprising Solo In Style (the persons comprising Solo in Style being the “Indemnified Parties”).

On behalf of yourself, your executors, administrators, heirs, next of kin, successors and assigns, and anyone else who may sue on your behalf, you hereby acknowledge, understand and expressly assume and accept all such risks and responsibility for any damages, liabilities, losses or expenses which you incur as a result of your participation in Solo In Style Events.

Waiver

On behalf of yourself, your executors, administrators, heirs, next of kin, successors and assigns, and anyone else who may sue on your behalf, you hereby waive, release and discharge each and every Indemnified Person from any and all claims, losses or liabilities for death, personal injury, partial or permanent disability, property damage, medical or hospital bills, theft or damage of any kind, including economic loss, which may in future arise out of or relate to your participating in a Solo In Style event, or your travelling to and from a Solo In Style event; even if such claims, omissions or liabilities are caused by the negligent acts or omissions of the persons you are hereby releasing or are caused by the negligent acts or omissions of any other person or entity.

Agreement Not To Sue

On behalf of yourself, your executors, administrators, heirs, next of kin, successors and assigns, and anyone else who may sue on your behalf, you agree not to sue any of the Indemnified Persons for any of the claims, losses or liabilities that you have waived, released or discharged herein, or that occur as a result of risks you have assumed.

This Agreement

You hereby warrant that you have read this Agreement carefully, understand its terms and conditions and acknowledge that you will be giving up substantial legal rights by signing it (including the rights of the minor, your spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns).  You acknowledge that you have signed this Agreement freely and voluntarily, without any inducement, assurance or guarantee, and intend for your signature to serve as confirmation of your complete and unconditional acceptance of the terms, conditions and provisions of this Agreement.

Please sign below to confirm that you have read and understand this waiver, and that you are aware that Team Lipstick, LLC is the hired company through which you are booking this event, therefore governed by the state of New York, USA.
